Equity in Athletics Data Analysis

The Equity in Athletics Data Analysis is provided by the Office of Postsecondary Education of the U.S. Department of Education.

This analysis cutting tool was designed to provide rapid customized reports for public inquiries relating to equity in athletics data. The data are drawn from the OPE Equity in Athletics Disclosure Website database.

This database consists of athletics data that are submitted annually as required by the Equity in Athletics Disclosure Act (EADA), via a Web-based data collection, by all co-educational postsecondary institutions that receive Title IV funding (i.e., those that participate in federal student aid programs) and that have an intercollegiate athletics program.

Is Title IX Safe?

You may wonder what Title IX has to do with the Affordable Care Act. The answer is in the Constitution. 

Congress can only pass legislation pursuant to one of its constitutionally enumerated powers, and for both Title IX and one provision in the Affordable Care Act, Congress relied on the same provision -- the Spending Clause.  This provision of the Constitution gives Congress broad power to spend money.

In the case of Title IX, recipients of federal education funding agree not to discriminate on the basis of sex.  In the case of the Affordable Care Act, one of its provisions asked states who agree to take federal funding for Medicaid to expand its coverage to include individuals with a higher income level than the current eligibility level.  While the Supreme Court upheld most of the Affordable Care Act under a different constitutional provision, the Court struck down the Medicare expansion as a violation of the Spending Clause.   Given that Title IX is also Spending Clause legislation, the question became, "Does the Supreme Court decision about the Affodable Care Act jeopardize Title IX?"

In a recently published issue brief, the American Constitution Society and author Emily Martin explain that, notwithstanding the Court's new Spending Clause jurisprudence, Title IX remains safe from attack.

Title IX Turns 40!

Title IX was enacted by Congress 40 years ago tomorrow!

Although Title IX is best known for breaking down barriers in sports for women and girls, there's much more to it.

The law also opens the door for girls to pursue math and science, requires fair treatment for pregnant and parenting students, and protects students from bullying and sexual harassment, among other things.

Since the law was passed, participation in sports by young women and girls has risen an incredible 90 percent.

We've come a long way since the enactment of Title IX -- the federal civil rights law that prohibits sex discrimination in education. Still, far too many students are denied equal educational opportunities.

Let's commit to working even harder to level the playing field once and for all.

Women in Sports History

During Women's History Month, we'll be featuring a post each week from America Comes Alive! on little-known American women's history.

Kitty O’Neil (1947- ) O’Neil was the first woman to be accepted into Stunts Unlimited (1976), an organization of Hollywood’s top stunt people.

O’Neil was an incredible athlete who swam competitively but then began to specialize in diving; she finished twelfth in the U.S. team trials for the Tokyo Olympics in 1964, but she contracted spinal meningitis which ended her Olympic dreams. She went on to race boats, cars, and motorcycles, setting many speed records. Several of her stunts also set records: In 1977 she completed the longest fall for a woman and the highest attempted fall while afire in a protective suit.

O’Neil accomplished all this despite being totally deaf. She had suffered measles, mumps, and chicken pox at the age of four months, which caused profound hearing loss. Her mother was determined that Kitty would get an education and grow up normally, and she did that and more.

Football Players Against Trafficking

Every year, the city that hosts the Superbowl sees an influx of girls and women trafficked for the sex trade for Superbowl-goers.  It's fantastic to see this campaign to bring awareness of this heinous business of modern slavery using pro football players, and it's especially heartening to hear them speaking about their own daughters.
